PROGRAM OVERVIEW:
The first part of this program will examine cases where the attorney’s failure to supervise staff resulted in significant problems. The speakers will discuss the ethics rules governing the supervision of staff and attorney grievances related to insufficient supervision of legal staff. The second part of the program will be an overview of Interest On Lawyer Account (IOLA) funds. At the end of the program, attorneys will have an opportunity to ask questions about IOLA funds.

PATRICIA MCGRATH, DEPUTY CORPORATION COUNSEL, CITY OF LOCKPORT
Ms. McGrath is a very skilled attorney and presenter who has practiced in private, corporate, and not-for-profit settings. She also taught business law and ethics as an adjunct instructor at Medaille College. Throughout her career, Ms. McGrath has been responsible for managing staff attorneys, paralegals, and support staff. In her current position as Deputy Corporation Counsel for the City of Lockport, Ms. McGrath represents the City in court and other legal matters. She is tasked with reviewing any action taken on behalf of or against the City or its representatives. Prior to serving in her current position, Ms. McGrath worked for several years as a supervising attorney at Neighborhood Legal Services, a not-for-profit legal services provider. She was a sole practitioner with a focus on family, matrimonial, and business law, along with mediation and appellate practice. Ms. McGrath also worked as in-house counsel for several companies.
RODERICK QUEBRAL, FORMER PRINCIPAL COUNSEL FOR THE 8TH JUDICIAL DISTRICT GRIEVANCE COMMITTEE
Mr. Quebral is a frequent lecturer on topics related to ethics and professional responsibility for continuing legal education programs in Western New York. He is a member of the New York State Bar Association and was appointed to the Committee on Standards of Attorney Conduct in 2020. He is a member of the Bar Association of Erie County (Professional Ethics Committee) and the St. Thomas More Guild, for whom he has served on the Board of Directors and as Treasurer. Mr. Quebral was an Assistant District Attorney in Erie County from 1985-1992, including service in the Comprehensive Assault, Rape and Abuse Bureau, the Special Investigations/Prosecutions Bureau, and as an Assistant Bureau Chief in the Felony Trial Bureau. He joined the staff of the Attorney Grievance Committees of the Appellate Division, Fourth Department, Eighth Judicial District in 1992 as an Associate Counsel, and served as a Principal Counsel for the Eighth Judicial District Grievance Committee in Buffalo until his retirement from government service in 2018.

Erik Teifke, Esq. is the Second Assistant Public Defender with the Office of the Monroe County Public Defender. In addition to representing clients at countless trials, Erik has engaged in extensive attorney training throughout New York State. He has served as a professor at Syracuse University College of Law since 2011 where he has directed the Criminal Defense Clinic and taught Trial Practice and Jury Selection. Erik also serves as a mentoring attorney through the Onondaga County Assigned Counsel Program.

U.S. immigration law intersects with criminal defense, family law, corporate law, human rights, and the arts and entertainment. The program will provide a broad outline of U.S. immigration law including the agencies which administer immigration law, nonimmigrant and immigrant family and employment-based classifications, the concepts of inadmissibility and deportability, asylum and refugee law, obtaining and maintaining U.S. lawful permanent residence, and the ways in which U.S. citizenship may be obtained. This overview will provide attorneys with an introduction to spotting issues in cases in other areas of law which may have a negative impact on an individual’s immigration status. Hot topics and recent development also will be discussed. Resources will be provided for those who wish to further develop their knowledge of U.S. immigration.

About the Speakers:
Lindsay A. Curcio has practiced immigration law since 1990. She is a sole practitioner located in Niagara Falls, New York and previously, Brooklyn, New York and Chicago, Illinois. Her practice includes employment-based and family-based nonimmigrant and immigrant visas as well as waivers, removal defense, asylum, U.S. citizenship issues, and naturalization. Ms. Curcio taught immigration law as an adjunct professor at New York Law School and Molloy College. She is an active member of the American Immigration Lawyers Association. She is a co-author of the first edition of Immigration and Nationality Law: Problems and Strategies (Lexis/Carolina Academic Press 2013). She was co-director of New York Law School’s Justice Action Center’s Safe Passage Immigration Project (focusing on special immigrant juvenile status) from 2007 to 2012. Ms. Curcio was awarded a bachelor’s degree in Spanish from Northwestern University, a juris doctor degree from IIT-Chicago Kent College of Law, an MBA from Fordham University, an LLM in Transnational Commercial Practice from the Center for International Legal Studies/Lazarski University, and a graduate certificate in healthcare compliance from the University of Pittsburgh Law School. She has received the SuperLawyers designation for Immigration Law. Her creative endeavors include studying, performing, and teaching improv as well writing short stories. This program will provide a summary of the provisions of the Child-Parent Security Act, codified in Family Court Act section 5-c. This statute went into effect on 2/15/2021, and provides a mechanism for parents who have used assisted reproduction technology to establish their parental rights. We will also provide an update on significant changes to the Social Services Law statute which governs the Statewide Central Register and their records, related to indicated (founded) CPS (Child Protective Services) reports.

About the Speakers:
Hon. Laura A. Wagner is a Support Magistrate in the Niagara County Family Court. Magistrate Wagner previously worked as an Assistant Social Services Attorney for the Niagara County Department of Social Services for over 17 years, and was promoted to Chief Counsel in 2020. She provided legal consultation to Child Support Enforcement, Child Protective Services, Child Welfare and Adult Protection Services Units. In 2013, Magistrate Wagner was elected as Town Justice in the Town of Royalton where she currently presides over criminal, traffic, small claims and landlord/tenant proceedings. She is also designated and trained as an Accessible Magistrate for the New York State Youth Part. Ms. Wagner obtained her certification as a Child Welfare Law Specialist by the National Association of Counsel for Children in 2016. Magistrate Wagner earned her Bachelor of Arts in Political Science from the University of Rochester in 1999 and Juris Doctor from University at Buffalo, School of Law in 2002. She was admitted to the New York State Bar in 2003.
Sarah Hedden the Supervising Attorney of the Kinship Care Legal Services Program at the Center for Elder Law & Justice in Buffalo, New York. She represents non-parent relatives of children at risk of placement in foster care. She worked previously as a Licensed Master Social Worker in the child welfare system. Sarah is a member of the Advisory Council to the Supporting Grandparents Raising Grandchildren Act, Secretary of the Board of Directors of the Niagara County Bar Association, and member of the Board of Directors for two non-profit agencies. Sarah earned her Bachelor of Science in Social Work from SUNY College at Buffalo in 2009, Master of Social Work from SUNY School of Social Work in 2013, and Juris Doctor from SUNY Buffalo Law School in 2014. Sarah was admitted to the New York State Bar in 2015.
